01. Acceptance of Terms
By accessing and using MailMyWay ("the Service"), provided by MailMyWay Enterprise ("the Company"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease all use of the Service. These terms constitute a legally binding agreement between you and the Company.
02. Service Description & AI Usage
MailMyWay provides AI-orchestrated tools for professional outreach and recruitment automation. Our system utilizes generative AI models to synthesize communication templates.Disclaimer: AI-generated content is probabilistic. We do not guarantee absolute factual accuracy or successful responses. Users are solely responsible for all communications dispatched through their authenticated Gmail accounts.
03. Subscription & Billing
3.1 Billing: Subscriptions are billed in advance on a monthly or annual basis. All payments are processed through secure third-party gateways (Stripe/Razorpay).
3.2 Cancellations: You may cancel your subscription at any time through the Command Center dashboard. Cancellation will take effect at the end of the current billing cycle.
3.3 Refunds: Refunds are handled according to our separate Refund Policy. Generally, partial-month credits are not refunded.
04. Prohibited Conduct (Spam Policy)
MailMyWay maintains a zero-tolerance policy for spam and unauthorized bulk marketing. You agree NOT to use the Service for:
- Sending unsolicited commercial emails (Spam) in violation of CAN-SPAM or similar laws.
- Generating or distributing phishing content or malware.
- Harassment, stalking, or any form of professional impersonation.
- Exceeding daily Gmail API limits to the detriment of system stability.
Violation of this section will result in immediate permanent suspension without warning or refund.
05. Data Protection & Compliance
We comply with applicable data protection laws, including the Information Technology Act (India)and, where applicable, GDPR principles. Your lead data is cryptographically isolated. The Company does not "sell" or trade your professional target lists to third parties.
06. Termination
We reserve the right to suspend or terminate your account at our sole discretion if we detect fraudulent activity, payment failures, or breaches of these Terms. Upon termination, your right to use the Service will immediately cease.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILMYWAY ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST JOB OPPORTUNITIES, REVENUE LOSS, OR GMAIL ACCOUNT SUSPENSIONS BY GOOGLE.
